This proposed marketplace section is not yet part of the terms that govern a purchase. It must be reviewed with the complete Terms and Conditions, the payment provider’s confirmed setup, and applicable consumer law before it is published as effective.
New Gear orders and seller fulfilment
When online checkout becomes available, each New Gear listing will identify the dealer responsible for supplying the product. Unless an order page clearly says otherwise, the purchase contract for the product is between the buyer and that dealer. ProAudioHive provides the marketplace and payment facilitation described at checkout; it does not itself stock or dispatch dealer products.
Dealers are responsible for keeping their listings, stock or availability, prices, shipping options and delivery estimates accurate; accepting and fulfilling orders; dispatching the item; providing valid tracking where available; and responding to buyer questions and order problems. Dealers must ship within the handling time shown for the listing or order and must not mark an order as dispatched before it has been handed to the carrier.
Payment status and payout timing
A successful payment confirms that the payment was accepted; it does not by itself confirm that the item has shipped or arrived. Where the payment and seller-account configuration supports it, seller funds may be held from payout while an order is being fulfilled. ProAudioHive may use order status and shipping or delivery information to determine when funds become eligible for payout, subject to the payment provider’s rules, applicable law, and any notice shown to the buyer or dealer.
Any payout hold is a payment-processing control, not an escrow service, guarantee of delivery, or guarantee that funds can be recovered after payout. A hold may not be available for every dealer, country, payment method or transaction. The applicable payout status and expected timing will be shown when the checkout and payout arrangements are finalised.
If an order is not shipped or delivered
If a dealer does not dispatch an order within the stated handling time, or tracking does not show delivery within the stated estimate, the buyer should contact the dealer and may contact ProAudioHive through the order support channel. ProAudioHive may request information from the dealer, review available tracking, pause a payout where the payment setup permits, and help route a refund or payment dispute under the applicable payment-provider process and these terms.
Where a payment remains refundable and the relevant rules allow it, a refund may be issued to the original payment method. If funds have already been paid out, a refund or recovery may depend on funds remaining available, the payment-provider configuration and rules, and applicable law. ProAudioHive does not promise that it can reverse a completed bank payout or recover money from a dealer who has withdrawn or spent it.
Buyer rights and seller obligations
Nothing in these proposed terms is intended to exclude, restrict or modify a right or remedy that cannot lawfully be excluded. Buyers may have statutory rights against the dealer or other responsible business, and ProAudioHive’s role and obligations may depend on the circumstances. This section is not a substitute for a consumer-rights policy tailored to the countries in which the marketplace operates.

New Gear listings may be submitted and reviewed before checkout opens. Until the site expressly enables checkout for a listing, no online order or payment can be made through ProAudioHive, and the payout and order-support processes described above are proposed policy only.
